CLAIMING INSURANCE BENEFITS FROM THE GENERAL ORGANIZATION FOR SOCIAL INSURANCE PROCEDURE (GOSI)

  • The General Organization for Social Insurance (GOSI) provides social insurance benefits to a deceased expatriate member who died in the Kingdom of Saudi Arabia who died as a result of a work-related accident.
  • The sponsor will formally notify the GOSI Overseas Benefits Department of its employee’s death. The medical and police reports released by the concerned hospital and police authorities determine the employee’s cause of death.
  • If an Overseas Filipino Worker is a member of GOSI and dies as a result of his job, the GOSI Overseas Benefits Department will deliver the GOSI form (together with a list of requisite legal documents) to the deceased OFW’s reported legal beneficiaries in the Philippines by registered mail. The involved Regional Trial Court or Municipal Trial Court must complete and notarize the GOSI form. In addition, the Department of Foreign Affairs and the Saudi Arabian Embassy in Manila must both authenticate the GOSI form and the requisite legal documents. The GOSI form and the relevant legal documentation should be returned back to GOSI-Riyadh Overseas Benefits Department after the appropriate authentication has been completed.
  • GOSI-Riyadh will process the GOSI form and documents that have been provided, and if all of the documentation are in order, the insurance benefits will be computed, and the cheque will be issued directly to the deceased OFW’s beneficiaries.
  • Only the beneficiaries of the deceased OFW will be contacted by GOSI-Riyadh, and their insurance funds will be mailed to them directly. Insurance benefits will no longer be administered by the Philippine Embassy or any other Philippine or Saudi government entity.
  • If the beneficiaries of a deceased OFW request it, the Philippine Embassy can only check the status of the insurance benefits with GOSI-Overseas Riyadh’s Benefits Department. The Embassy will next obtain the dead OFW’s GOSI number. The GOSI number is a nine-digit number that begins with the number eight.

What is social insurance in Saudi?

Social insurance contributions are calculated at 2% for non-Saudi employees (note that this is not social insurance, but occupational hazard), and are paid by the employer on a monthly basis based on the monthly basic pay plus housing (paid or in kind) with a maximum of SAR 45,000. The rate is 22% for Saudi employees, and it is paid by both the employee (10% = 9% social insurance + 1% unemployment insurance) and the employer (12% = 9% social insurance + 2% occupational hazard + 1% unemployment insurance).

What are social insurance contributions?

The majority of employers and employees (over 16 years of age and under 66 years of age) contribute to the national Social Insurance Fund (PRSI). In general, social insurance contributions are required. The word “insurableemployment” refers to work that is subject to social insurance contributions. Some people with unearned income may be subject to PRSI.

The Social Insurance Fund is divided into two accounts: a current account and an investment account, both of which are overseen by the Ministers of Social Protection and Finance, respectively. The current account is made up of funds gathered from employees. This money is then used to pay for social security benefits. The Minister of Finance manages the investment account, which is a savings account. The Comptrollerand Auditor General is in charge of keeping the books in order and submitting reports to the Houses of the Oireachtas.

Social insurance classes

Contributions to social insurance are separated into multiple groups, known as classes or contribution rates. The type of your work determines the contribution class and rate you pay. A individual working at a supermarket and earning less than €38 per week, for example, will be covered under Class J. If that person earned more than €38, they would almost certainly be covered by Class A insurance. The majority of employees pay PRSI in Class A.

Is GOSI mandatory in Saudi Arabia?

Under a new plan proposed by the Ministry of Labor, expatriate workers can now become beneficiaries of the General Organization For Social Insurance (GOSI).

The declaration came after a meeting at the Ritz Carlton Hotel in Riyadh late Saturday with officials from the Labor Ministry and representatives from other foreign ministries.

The Ministry of Labor had invited all heads of foreign missions, as well as labor counselors from embassies and consulates, to inform them of the most recent labor legislation and the amnesty conditions announced by the government on Friday.

On behalf of Labor Minister Adel Fakeih, his deputy minister, Moufarrej bin Saad Al-Hagbani, hosted the meeting and held a wide variety of discussions with international diplomats on labor matters.

The deputy minister said that if expatriates were not already enrolled under the insurance plan, the GOSI would register their names today.

GOSI was originally voluntary for expats but is now mandatory for all Saudis. Until now, however, private enterprises had the option of refusing to enroll their expat employees in GOSI. Expats can now register for GOSI, and their private employers can no longer refuse them.

The date on which a non-Saudi worker arrives in Saudi Arabia, or the day on which his job is transferred to another employer, will be the date on which he is registered with GOSI’s professional hazards division, according to GOSI governor Sulaiman Al-Quwaiz. The records will begin to appear on the first day of the month after the modification.

“However, a non-Saudi subscriber’s record would be locked when he leaves the country permanently or when his services are transferred to another employer,” he stated.

According to Al-Quwaiz, the subscriber begins to receive benefits as soon as he registers. Full medical coverage is included in the benefits package.

Meanwhile, foreign ambassadors have expressed alarm about the short window of opportunity for expats to legitimize their status. On July 3, the grace period will come to an end.

The amnesty term is too short, according to envoys. They also wanted to know more about the implementation process.

According to diplomats who attended the closed-door conference, Saudi officials told the envoys that their ministries would work around the clock if required to speed the process and meet the deadline, but they ruled out any extension of the grace period.

To speed up the process, several embassies requested that Saudi officials be designated for certain concerns at the passport and labor offices.

According to Saudi authorities, if departing candidates do not have their original passports, foreign diplomatic missions may provide travel documents that can be processed at Passport offices and allow them to go.

Speaking on Nitaqat and the government’s amnesty, Al-Hagbani warned that after the grace period, illegal expatriates will face an SR 100,000 fine and a two-year prison sentence.

“The fundamental point of the program,” the deputy minister explained, “is to ensure a healthy work environment in the Kingdom free of illegal stayers.” He went on to say that the administration is looking for high-quality employees. The government wants to make sure that every foreign worker is properly documented, he said.

The new provision for the GOSI insurance, according to Pakistan Ambassador Muhammed Naeem Khan, is a relief for foreign workers. He recalled a recent traffic accident in which some Pakistanis perished, and the sponsor was unable to compensate the workers who died. The new system would provide some relief to the families of those who die in such situations.

Sibi George, deputy chief of the Indian Embassy, described the meeting as “great” and said it was beneficial to all labor-exporting countries. “During the implementation of the program, we were able to acquire the proper counsel on some of the challenges that the missions were having,” George added.

With the support of the immigration service, the ambassador said his mission was able to prepare 10,000 passports for its citizens.

Ambassador Shahidul Islam of Bangladesh said the envoys had a great opportunity to clarify a variety of concerns. He also took the opportunity to praise the Saudi rulers for allowing Bangladeshis to switch sponsorship. “This is fantastic news for the community, and impacted expatriates may now easily correct their visa status,” he said.

Islam stated that his embassy in Riyadh and the general consulate in Jeddah will hold camps in several locations throughout Saudi Arabia to provide emergency consular services to Bangladeshis. “We’re bringing consular services to their doorstep so they can take use of them without having to travel to their country’s faraway missions,” he explained.

Anura Muthumala, Sri Lanka’s Labor Counselor, said his mission has begun implementing the program in order to meet the deadline before the grace period expires. To reach out to his compatriots, he stated his mission will have mobile consular services in Dammam, Hail, Al-Qassim, and Saqaka.
