What rights do asylum seekers have in the UK?
Asylum seekers are individuals who have landed in a country and requested asylum. They are known as asylum seekers until a judgement is made on whether or not they are a refugee. This means that they do not have the same rights as a refugee or a British citizen in the United Kingdom. Asylum seekers, for example, are not permitted to work.
The legal right to seek refuge is one that we all have. Asylum is a legal process, hence it is not criminal to apply for asylum. It’s also not criminal to be denied asylum; it merely means you didn’t meet the stringent requirements for proving your need for refugee protection.
Can asylum seekers apply for citizenship?
To become a U.S. citizen, you must complete all of the eligibility requirements. In general, you can apply for naturalization after a specified number of years as a valid permanent resident. Can asylum seekers work in the UK?
According to the government’s independent experts, the ban on enabling asylum seekers to work should be abolished, and care workers should be given immediate access to fast-track visas.
The Migration Advisory Committee (MAC) said on Wednesday that the government should reveal evidence to back up ministers’ claims that enabling claimants to work will operate as a “pull factor” for people to visit the UK.
The committee said in its annual report to Priti Patel, the home secretary, that there was clear evidence of the harm caused by the work prohibition and that a change of policy was required in light of the recent drownings in the English Channel.
Asylum seekers are currently prohibited from working unless their claims have been pending for 12 months due to no fault of their own. After that, individuals must request for approval from the Home Office and can only apply for positions that are listed on the official shortage occupation list.
Last Wednesday, immigration minister Tom Pursglove said the ban must be maintained to “lower pull factors to the UK” and “ensure our policies do not encourage people to undercut the existing labor force.”
Prof Brian Bell, the MAC head, said on Wednesday that he had not seen evidence to support the “pull factor” assessment and that ministers should make this information public.
“Simply stating, ‘There is a pull factor,’ is insufficient. You must have proof to back up your claim. “You can’t reach conclusions until you’re ready to tell us what the evidence on one side of the equation is,” he explained.
Sajid Javid, the then-home secretary, informed parliament in December 2018 that he wanted to reconsider the prohibition after the Lift the Ban coalition found that allowing asylum seekers to work could produce £42 million per year for the government.
In June 2021, there were over 56,600 asylum applications awaiting an initial determination, with 75 percent of them having been on hold for more than six months. This is up from 33% just five years ago.
In a September interview with the Spectator magazine, Dominic Raab, the justice secretary, said he would support allowing asylum seekers to work.
The committee also recommends that persons working in social care be included to the shortage occupation list, which was established after free movement across the EU ended in January.
The proposal comes after months of warnings from the social care sector that it is experiencing serious staff shortages as a result of Brexit and the requirement that all workers be vaccinated against Covid-19.
“Given the significant and escalating difficulties encountered by the care industry, the report brings forward preliminary findings on adult social care,” the committee stated in a statement. The MAC proposes that the government quickly make care workers eligible for the health and care worker visa and declare the occupation as a shortage occupation.”
The list includes jobs where firms experience a labor shortage and it makes sense to hire foreign workers to fill such openings. It is ultimately up to the government to determine whether or not to accept the recommendation.
