A Tempur-Pedic mattress is an excellent choice for persons who have back or spinal ailments. A Tempur-Pedic mattress is made to correct your spine and relieve pressure. Mattresses, on the other hand, are only considered medically necessary by Aetna when a hospital bed is required. The same is true for BCBS, which only pays for the mattress if a hospital bed is a medical necessity.

Is adjustable bed covered by insurance?

WARRANTY DESCRIPTION

If the purchaser files a claim under this Limited Warranty, Tempur-Pedic may seek verification of the quality of the foundation, adjustable bed base, or bed frame used in conjunction with the mattress. Tempur-Pedic offers no warranties or guarantees about the structural integrity or rated load of any frame, foundation, or adjustable base that is not made by or for Tempur-Pedic. Tempur-Pedic retains the right to void this Limited Warranty if the base is deemed to be inadequate or the mattress is found to be in an unclean state, in Tempur-reasonable Pedic’s opinion.

  • Deterioration that causes a noticeable indentation in the mattress that is greater than three-quarters (0.75) of an inch and is not caused by the use of an inappropriate or unsupportive foundation or adjustable bed base. Normal wear necessitates that a purchaser’s mattress be constantly supported by a matching foundation or adjustable bed base, as well as a proper bed frame capable of supporting the mattress and foundation’s combined weight.
  • A good bed frame should support both the mattress and the foundation, with a center support and at least 5-6 legs for queen, king, and cal king mattresses, and 4 legs for twin and full mattresses.   • Please Note: Tempur-Pedic highly recommends a 3-bed beam support system (available at an additional cost from Tempur-Pedic or a retailer) or a support system of comparable quality that is designed specifically to provide additional structural support to slatted style bed frames for queen, king, and cal king mattresses.
  • Any physical defect in the mattress that causes the TEMPUR material to split or shatter despite good handling and typical use (as outlined in the Mattress Use & Care Instructions).
  • Any manufacturing flaws in the mattress cover’s zipper assembly. Tempur-Pedic reserves the right to repair or replace the mattress cover at its discretion. If Tempur-Pedic changes the mattress cover, it will be replaced with the most recent model of cover available for the mattress, which may be a different color or material than the original cover.
  • A normal softening of the TEMPUR pressure-relieving material that has no effect on the mattress’s pressure-relieving properties.
  • Burns, cuts, tears, liquid damage, or stains are examples of physical abuse or damage to the structure and/or cover material. However, if the mattress has a warranty flaw that is not caused by misuse or damage, it will be covered under the normal guarantee.
  • An incorrect bed frame, foundation, or adjustable base might cause damage. A appropriate bed frame can be found in the preceding description and photos.
  • If only one piece of a Tempur-Pedic sleep system is defective, the adjacent piece must be replaced, unless the accompanying piece is also defective.
  • Demonstration samples or floor models ( “demos”) are available at a reduced price (See separate warranty for demos and floor models).
  • Resellers that are not authorized retailers sell the product. 8. Product offered “as-is,” “preconditioned,” “reconditioned,” “used,” “comfort return,” “returned,” “previously owned,” or any other similar phrase implying that the item is not “new” or of “good” quality “first quality,” or has been previously purchased or used by a customer.

Product Replacement Terms

Tempur-Pedic will not charge purchaser to repair or replace purchaser’s mattress or flat base if it is judged defective within the term of this 10 year Limited Warranty, but purchaser is responsible for all transportation expenses related with repairs or replacements. The transportation costs, in any case, will not exceed Tempur-then-standard Pedic’s freight prices. A replacement product does not come with a new warranty. The replacement product’s warranty begins on the date of the original purchase of the replaced product. It should be noted that any pump, hose, or remote provided with, or contained with, any Tempur-Pedic product is warranted for five (5) years, with the warranty period beginning at the time of purchase, unless the product is a demonstration or floor model, in which case the warranty period begins with the product’s manufacturing date as provided on the product’s law tag. If such a pump, hose, or remote is found to be malfunctioning, Tempur-Pedic may repair or replace the component at its discretion. In the case that repair is required, the Purchaser will not be charged for the repair or replacement, with the exception of transportation charges. If a purchaser elects to upgrade to a more expensive product in connection with the replacement of a product in accordance with the terms of this Limited Warranty, it may do so by paying the difference between the cost of the original product being replaced and the cost of the upgraded product, as well as the cost of any related additional sleep system pieces not being replaced as part of the warranty exchange. A new warranty will be issued for the upgraded items only in the event of an upgrade as indicated in this paragraph.

Demonstration Samples and Floor Models

Except as otherwise stated below for the pump, hose, or remote included with, or contained within, a Tempur-Pedic product, demonstration samples (“demo(s)”) and floor model(s) will be covered by a 10-year limited warranty starting from the date of purchase on the receipt. Demonstrations and floor models are sold “as is” and “with all faults,” save for confirmed warranty flaws, and covers on demos and floor models (whether detachable or not) are not warranted or guaranteed. Tempur-Pedic will repair or replace demo or floor model items acquired at a discount within this Limited Warranty at no cost to the purchaser, or at a cost equal to the cost of the replacement product less the amount paid by the original purchase for the demo or floor model. If the demo or floor model product is no longer available, the replacement charge will be the cost of a fair equivalent (or any improved item) less the amount paid by the original purchaser for the demo or floor model product.

Mattress Covers

If the cover for the Tempur-Pedic product is removable, it is assured for ten (10) years from the date of purchase against defects in material or workmanship (except for demo or floor model covers). Tempur-Pedic maintains the right to repair the cover if it is damaged. If Tempur-Pedic decides to replace the mattress cover, it will do so with the most recent model of cover available for the mattress, which may be a different color or material than the original cover.

Flat, Non-Adjustable Tempur-Pedic Foundations

Tempur-Pedic foundations are made to function with a bed frame that can sustain the foundation’s weight as well as an approved mattress. This Limited Warranty, as well as other performance assurances, are based on testing performed on “sets,” which include our mattresses and foundations. Tempur-Pedic makes no claims about the structural integrity or rated load of any frame that is not made by or for Tempur-Pedic. Tempur-Pedic retains the right to void this Limited Warranty if the frame is deemed to be inadequate or the foundation is discovered to be in an unclean state, in Tempur-reasonable Pedic’s opinion.

  • Physical abuse or damage to the foundation’s structure and/or cover material, such as burns, cuts, tears, or liquid damage, is prohibited.
  • Tempur-Pedic sleep system replacement (e.g., mattress, adjustable base, pillows, etc.) unless the other element is similarly damaged.
  • Product offered “as-is,” “preconditioned,” “reconditioned,” “used,” “comfort return,” “returned,” “previously owned,” or any other similar phrase implying that the item is not “new” or of “first quality,” or that it has been previously purchased or used by another customer.

Foundation Replacement

If the foundation is discovered to be damaged, Tempur-Pedic will not charge the buyer to repair or replace it, but the buyer is responsible for all transportation charges involved with the repairs or replacements. The transportation costs, in any case, will not exceed Tempur-then-standard Pedic’s freight prices. A replacement foundation does not come with a new warranty. The new foundation’s warranty begins on the date of the original purchase of the foundation. If a purchaser elects to upgrade to a more expensive product in connection with the replacement of a product in accordance with the terms of this Limited Warranty, it may do so by paying the difference between the cost of the original product being replaced and the cost of the upgraded product, as well as the cost of any related additional sleep system pieces not being replaced as part of the warranty exchange. A new warranty will be issued for the upgraded items only in the event of an upgrade as indicated in this paragraph.

Foundation Demonstration Samples and Floor Models

Demonstration samples (“demo(s)”) and floor model(s) of a Tempur-Pedic flat, non-adjustable foundation will enjoy a 10 year limited warranty from the date of purchase provided on the receipt, unless otherwise provided herein regarding the pump, hose, or remote provided with, or contained within, a Tempur-Pedic product. Demonstrations and floor models are sold “as is” and “with all faults,” save for confirmed warranty flaws, and covers on demos and floor models (whether detachable or not) are not warranted or guaranteed. Tempur-Pedic will repair or replace demo or floor model goods acquired at a discount during the Limited Warranty at no cost to the purchaser, or at a cost equivalent to the cost of the new foundation less the amount paid by the initial purchase for the demo or floor model. If the demo or floor model product is no longer available, the replacement charge will be the cost of a fair equivalent (or any improved item) less the amount paid by the original purchaser for the demo or floor model product.

Additional Limitations on Warranty Coverage

If a warranty claim is submitted and a warranty replacement is determined to be necessary, the purchaser must return the original product to Tempur-Pedic at the time of replacement. TEMPUR-PEDIC SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF THIS PRODUCT OR FROM ANY BREACH OF THIS WARRANTY; THE EXCLUSIVE REMEDY FOR BREACH OF THIS WARRANTY SHALL BE REPLACEMENT OR CREDIT TOWARDS REPLACEMENT AS SET FORTH HEREIN. OTHER THAN THE WARRANTY DESCRIBED ON THE FACE OF THIS LIMITED WARRANTY, THERE ARE NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Binding Arbitration and Class Action Waiver for U.S. Residents

(a) Except for a Dispute relating to the enforcement or validity of your, Tempur- Pedic’s, or any of our licensors’ intellectual property rights, this section applies to any dispute. “Any disagreement, action, or other controversy between you and Tempur-Pedic regarding your TEMPUR-PEDIC mattress or this guarantee, whether based on contract, warranty, tort, statute, regulation, ordinance, or any other legal or equitable basis is referred to as a “dispute.” “The term “dispute” will be given the broadest legal interpretation conceivable.

(b) If you or Tempur-Pedic have a dispute, you or Tempur-Pedic must give the other a Notice of Dispute, which is a written statement that includes the party’s name, address, and contact information, the events that led to the dispute, and the relief sought. Any Notice of Dispute must be sent to Tempur-Pedic North America, LLC, ATTN: Office of General Counsel, 1000 Tempur Way, Lexington, KY 40511 by U.S. Mail. If we have your address, or if we have your e-mail address, Tempur-Pedic will send any Notice of Dispute to you via U.S. Mail. Within 60 days of receiving the Notice of Dispute, you and Tempur-Pedic will endeavor to resolve any dispute through informal negotiation. You or Tempur-Pedic may initiate arbitration after 60 days.

(c) You may also file a claim in small claims court in your home county or in Fayette County, Kentucky, if the dispute fulfills all of the small claims court’s standards. Whether or not you negotiated informally first, you can file a lawsuit in small claims court.

(d) Any other attempt to resolve a dispute between you and Tempur-Pedic will be undertaken exclusively through binding arbitration if you and Tempur-Pedic do not resolve the dispute through informal negotiation or small claims court. You are relinquishing your right to litigate (or participate as a party or class member in) all matters in front of a judge or jury in court. Instead, all disagreements will be settled by a neutral arbitrator, whose decision will be final, with the exception of a limited right of appeal under the Federal Arbitration Act. The arbitrator’s award can be enforced in any court that has jurisdiction over the parties.

(e) Any proceedings in any forum to resolve or litigate a dispute will be handled on an individual basis. Neither You nor Tempur-Pedic will file a class action, a private attorney general action, or any other proceeding in which either party acts or seeks to act in a representative role in any dispute. Without the prior written approval of all parties to all affected arbitrations or processes, no arbitration or proceeding will be joined with another.

(g) As specified below, Tempur-Pedic shall promptly return your filing fees and pay the AAA and arbitrator’s fees and expenses. If you reject Tempur-last Pedic’s written settlement offer made before the arbitrator was appointed (“Tempur-last Pedic’s written offer”), and the arbitrator awards you more than Tempur-last Pedic’s written offer, Tempur-Pedic will give you three incentives: I pay the greater of the award or $5,000; (ii) pay twice your reasonable attorney’s fees, if any; and (iii) reimburse any expensing. Unless you and Tempur-Pedic agree, the arbitrator will determine the amount of fees, costs, and expenditures. An email will be regarded a written communication for the purposes of this limited warranty.

(h) If the arbitrator deems the arbitration frivolous or brought for an improper purpose, Tempur-Pedic will seek reimbursement of its AAA or arbitrator’s fees and expenses, or your filing fees, only if the arbitrator finds the arbitration frivolous or brought for an improper purpose. Tempur-Pedic will pay all filing, AAA, and arbitrator fees and expenses in any arbitration it initiates. In any arbitration, Tempur-Pedic may seek reimbursement for its attorney’s fees and expenses. Fees and expenditures are not taken into account when calculating the cost of a dispute.

I To the extent that this guarantee contradicts with the AAA’s Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes, this warranty takes precedence.

(j) To the extent permissible by law, any claim or disagreement arising out of this Limited Warranty must be brought in small claims court, arbitration, or court within one year, unless otherwise provided herein. When the claim or Notice of Dispute is first submitted, the one-year timeframe begins. If you do not file a claim or challenge within one year, it will be permanently prohibited.

(k) If the class action waiver is found to be invalid or unenforceable in part or all of a dispute, it will not apply to those portions. Instead, those portions will be severed and dealt with in a court of law, while the remaining portions will be dealt with through arbitration. If any other provision of this section is determined to be unconstitutional or unenforceable, it will be struck out, leaving the rest of the section in full force and effect.

To the maximum extent permitted by law, or unless prohibited by law, all elements of this Limited Warranty apply. This Limited Warranty provides the buyer with specified legal rights, and the buyer may also have other legal rights that differ by state.

What kind of bed will Medicare pay for?

Outpatient medical costs, such as durable medical equipment, are covered by Medicare Part B. This includes beds that can be adjusted. When your doctor orders one for you to use at home, Part B will cover it.

Both your doctor and the company that will supply the bed must be enrolled as Medicare providers for Part B to cover your adjustable bed.
